In connection with your participation with Set Jet, you grant us permission to process a security check during the application process, in order to receive an approval (or non-approval) notice from the Transportation Security Administration, our Part 135 on-demand charter operator, and/or other participating law enforcement agencies. This process will only be used to approve (or not approve) you as a Set Jet Member. In addition, you grant us permission to periodically process additional security checks to confirm your identity and that you are not a security risk. This information will only be used to confirm your eligibility for Set Jet Membership and your continued participation with Set Jet.
We may collect additional information from you regarding your previous flight activities and travel habits. We may ask you to voluntarily provide us with information regarding your personal or professional interests, demographics, experience with our products and services, contact preferences and geographical expansion of service requests. For example, you may receive a request to provide Set Jet with your suggestions with respect to Set Jet possibly expanding its service to additional destination cities. This information may be combined with information about you which we gathered from other sources. We may use the information to design special offers customized to your interests. If you do not wish to participate, please opt-out of such promotions at the time of your initial Membership application, or at any later time by contacting us by email at the address below.
We may send you email promotions regarding vacation packages, special offers or exclusive Set Jet events, as well as other information that may be of interest to you. If you do not wish to receive such communications, you can simply opt-out of such communications at the time of your initial Membership application, or at any later time by contacting us by email at the address below.
We do not sell, transfer or share any Personally Identifiable Information about you to any third parties outside of Set Jet, its strategic partners, the TSA and other participating law enforcement agencies, or under exceptional circumstances as may be required by law or to protect legal rights.
We may collect, use and disclose information that is not Personally Identifiable Information (for example, we may keep track of, use or disclose aggregate statistics regarding the number of visitors to our web site and other information that does not uniquely identify you). Typically, this data is gathered through the use of automated “cookies.”

We retain Personally Identifiable Information about you for as long as necessary to provide you the Set Jet Services. In some cases, we retain Personally Identifiable Information for longer, if doing so is necessary to comply with our legal obligations, or as otherwise permitted by applicable law. Afterwards, we may retain some information in a de-identified and/or aggregated form but not in a way that would identify you personally.

Any controversy, claim or dispute (collectively, “Dispute”) between you and Set Jet that may arise out of, or in connection with, your use and/or access to Set Jet’s website (“Website”) shall be resolved exclusively by binding arbitration administered by Judicial Arbitration and Mediation Services, Inc. (“JAMS”), pursuant to the JAMS Streamlined Arbitration Rules & Procedures, and conducted by a single, neutral arbitrator.
By using and/or accessing the Website, you agree that this constitutes a valid and enforceable written agreement to arbitrate under the Federal Arbitration Act, and that any dispute concerning this arbitration provision, including any such dispute as to the validity or enforceability of this provision, or whether a dispute or claim is arbitrable, shall be determined exclusively by the arbitrator selected by JAMS. If JAMS is unable or unwilling to arbitrate the Dispute, then the Dispute may be referred to any other arbitration organization or arbitrator the parties both agree upon in writing.
To start an arbitration proceeding, you must execute and serve a Demand for Arbitration on Set Jet by mailing it to 15011 N 75th Street, Scottsdale, AZ 85260, pursuant to the JAMS instructions. Arbitration shall take place by phone, unless an in-person hearing is requested either by you or Set Jet. In that case, the hearing shall take place in the county where you reside.
Neither you nor Set Jet will be able to have a court or jury trial, or participate in a class action or class arbitration. Other rights that you or Set Jet would have if you or Set Jet went to court will not be available or will be more limited in arbitration, including the right to appeal.
YOU AND SET JET ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED, REPRESENTATIVE ACTION, OR ANY SIMILAR PROCEEDING.
